  1. What are cookies

    Cookies are small text files that a website stores on the user’s device (computer, tablet, smartphone) during browsing. Cookies enable the website to recognise the user’s device and remember certain information about the visit (e.g. language preferences, session data).

    Other tracking technologies may serve similar purposes (such as web beacons, tracking pixels, local storage) — this Policy also covers such technologies.

    Classification by storage duration:

    • Session cookies — automatically deleted when the browser is closed
    • Persistent cookies — remain on the device for a specified period or until manually deleted by the user

    Classification by origin:

        (d) the third party does not use the data for its own purposes.

        If these conditions are not met — as in this case — consent is required.

  3. Cookie banner and consent

    Upon the first visit to kite-habits.pl, a cookie banner is displayed which:

    • informs about the use of cookies,
    • contains a link to this Cookies Policy,
    • allows the user to accept or reject specific categories of cookies (analytical, marketing),
    • allows acceptance of only technical cookies (“Reject all” or “Only necessary”).

    Garante requirements (10.06.2021):

    • The banner must include a rejection button as visible as the acceptance button
    • Continued browsing (scrolling) does not constitute valid consent
    • Consent must be given actively (opt-in), not by default (opt-out)
    • Analytical and marketing cookies must not be installed before consent
    • The banner must be shown again at least every 6 months (unless processing conditions change — then immediately)

    Consent is recorded and may be modified or withdrawn at any time — see section 5.

  4. Data transfers outside the EEA

    Third-party cookies (Google Analytics, Meta Pixel) may involve transfers of data to the United States. Details regarding legal bases for such transfers are provided in the Privacy Policy (section 7).

    Google LLC and Meta Platforms, Inc. are certified under the EU–US Data Privacy Framework (DPF), based on the European Commission Implementing Decision of 10 July 2023.

    MailerLite UAB (Lithuania, EU) uses Amazon Web Services (AWS) infrastructure, whose servers may also be located in the USA. Amazon Web Services, Inc. is certified under the EU–US Data Privacy Framework (DPF).

    Additionally: Standard Contractual Clauses (SCC) under the MailerLite Data Processing Agreement.

  5. How to manage cookies
    1. Via the cookie banner On first visit, the user selects cookie categories. Preferences can be changed at any time via the “Cookie settings” link available in the website footer.

  6. Tools that do not use cookies

    For completeness, the website also uses tools that do not install cookies but process data in other ways:

    1. Google Search Console

      Tool for monitoring website visibility in Google search results. Data concerns only the website (positions, queries) and is not collected directly from users via cookies. Data is processed in aggregated form on Google servers.

    2. WhatsApp link

      The website contains a link redirecting to the WhatsApp application. Clicking the link does not install cookies — it opens the WhatsApp app. Further data processing is subject to WhatsApp/Meta privacy policies.

    This Cookies Policy has been prepared in accordance with:

  8. Changes to the Cookies Policy

    The Company reserves the right to update this Policy in case of changes to tools used, legal regulations, or supervisory authority guidelines.

    The current version is always available on the website. In case of significant changes, cookie consent will be collected again.
